These Terms of Service ("Terms" or "TOS") constitute a legally binding agreement between you ("You," "User," or "Your") and Kidvoyage.com ("We," "Us," "Our," or "Company"), governing your access to and use of the Kidvoyage platform (the "Service" or "Platform"), accessible via https://kidvoyage.com, including any related mobile applications, features, content, or services.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service. These Terms apply to all users, including parents browsing camps ("Parents" or "Buyers") and camp providers listing services ("Providers" or "Sellers"). Your use is also subject to our separate Privacy Policy, Adding Content Policy, and Accessibility Statement. We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via email or platform notice.
The Service is an information site for parents who love to travel with their children, providing fresh ideas for holidays and helping organize travel. We do not sell tours, trips, airline tickets, or any other travel services directly. We provide information to help you make informed choices. All rights of access to the information posted on the Service, as well as the rights to use its services, are governed by this Agreement.
Users agree not to use the Service (in whole or in part) for commercial purposes unless they have a contractual relationship with Us (e.g., as a subscribing Provider). In addition, Users agree not to use the Service for:
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and are not barred from using similar services under applicable laws.
To access certain features (e.g., creating listings or inquiries), you must register an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use at contact@kidvoyage.com.
We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, especially for violations of these Terms. We may require contact information for verification and guarantee its confidentiality per our Privacy Policy. For EU users: You have the right to withdraw from account creation or subscriptions within 14 days without reason, subject to Section 6. Users can change registration information at any time via their account. You may delete your account voluntarily, but it cannot be restored—re-registration is required. Deletion does not affect non-registered use.
The Service is a travel guidance platform for parents in the US and EU. Parents can browse, search, and inquire about camps. Providers can subscribe to list camps, purchase promotions within our catalog, and access content management services. We do not operate camps or facilitate direct bookings/payments between Users; we connect parties and provide informational tools. All interactions between Parents and Providers are their sole responsibility.
Providers may subscribe on a paid basis to create and manage camp listings, including descriptions, photos, and details. Subscriptions are annual unless specified otherwise.
Providers grant us a non-exclusive, royalty-free license to use listing Content for platform purposes.
• Fees: Providers pay subscription fees and promo costs as specified on the Platform via accepted methods. Fees are non-refundable except as stated.
• Billing: Auto-renewal unless canceled 30 days prior. Taxes apply as required.
• Refunds and Cancellations: Refunds eligible within 14 days of payment if no services used. For EU users, this aligns with the 14-day cooling-off period. Disputes handled via email support at contact@kidvoyage.com.
We comply with FTC guidelines for fair practices. Failure to pay may result in account suspension.
You are responsible for any Content you post (e.g., listings). By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, display, and distribute it for Service operations. You represent that your Content is accurate, non-infringing, and complies with laws. We may remove Content violating these Terms. For detailed rules on adding content, including prohibitions and moderation, refer to our separate Adding Content Policy.
You agree not to:
• Post fraudulent, hateful, spam, or misleading Content.
• Infringe IP, privacy, or third-party rights.
• Engage in harassment, discrimination, or promotion of illegal activities.
• Upload viruses or disrupt the Service.
• Misrepresent affiliations or impersonate others.
• Solicit minors inappropriately or share child-sensitive data without consent.
Violations may lead to termination and reporting to authorities.
The Service, including logos, designs, and content (excluding User Content), is owned by us or licensors and protected by copyright, trademark, and other laws. You may not copy, modify, or exploit it without permission. The design, structure, images, appearance, icons, graphics, and color schemes constitute our corporate identity and cannot be copied without written permission. All trademarks, product names, and logos are property of their owners. Users may view, download, copy, and print materials for personal non-commercial use only. Copying for profit is prohibited. When posting on third-party sites, limit to 500-character announcements, no changes, and include an active link to the original page.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ACCURACY OF LISTINGS, AVAILABILITY, OR ERROR-FREE OPERATION.
We are not liable for Provider actions, camp quality, or User interactions. Visitors use the Service at their own risk. We cannot guarantee information is not outdated, including but not limited to:
Materials and services may not meet your requirements, and results may not be accurate. Ratings and recommendations are for informational purposes only. Links to third-party sites are operated by others; we are not responsible for their content, paid services, or quality. Clarify terms directly with them. We are not sellers and do not enter commercial relationships for third-party goods/services. Any posted information may contain errors or inaccuracies, including software, products, or services from third parties.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (E.G., LOSS OF PROFITS, DATA), EVEN IF ADVISED OF POSSIBILITY. LIABILITY IS LIMITED TO AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS.
We are not responsible for user-posted information, its loss, libel, slander, fraud, or resulting damage. For EU users: This does not limit liability for gross negligence, willful misconduct, or breaches of essential obligations.
You agree to indemnify, defend, and hold us harmless from claims, losses, or damages arising from your violation of these Terms, Content, or misuse of the Service.
We may terminate or suspend your access immediately for violations, without liability. Upon termination, your rights cease, but obligations (e.g., indemnification) survive.
For US users: Disputes resolved by binding arbitration under AAA rules in North Carolina, waiving class actions. For EU users: You may use courts in your residence or EU dispute resolution platforms. We may disclose user information if required by authorities per law.
These Terms are governed by the laws of North Carolina, USA, without conflict principles. For EU users, mandatory consumer protections apply.
If any provision is invalid, others remain enforceable. No waiver unless written. These Terms constitute the entire agreement.
